TikTok Disclosure Toggle Audit, Closing the Creator Campaign Gap

Jillian RhodesBy Jillian Rhodes02/11/20267 Mins Read

One missed toggle can get a paid post removed or restricted. TikTok’s mandatory disclosure tool, the commercial content disclosure setting, is no longer a creator courtesy. It is a platform requirement with enforcement attached. If your team still treats disclosure as a caption habit, your next campaign is exposed. This checklist closes that gap before launch.

What the tool requires, and who carries the risk

TikTok’s own help documentation is blunt. When you post content that promotes a brand, product or service, you must turn on the commercial content disclosure setting. The same page warns that if the proper disclosure is missing, a post may be removed or restricted.

The TikTok Branded Content Policy defines the scope broadly. It covers gifted product, paid posts, commission-based promotion through affiliate links or promo codes, and ongoing ambassador relationships. So “we only sent product” does not take you out of scope.

Here is the part brand teams skip. The policy places responsibility on the poster for legal compliance. But the FTC looks at advertisers too. Its Endorsement Guides FAQ says each new endorsement made without a disclosure could be deceptive, because viewers might not have seen the earlier posts. Your creator’s miss can become your problem.

The toggle is a platform control, not a legal shield. It proves a label was applied. It does not prove your campaign was compliant.

Audit step one: map every post type to a toggle path

The toggle sits in different places depending on the format. Creators who film in one place and post in another often miss it. TikTok’s documentation lists separate paths for the in-app post screen, an already published post, LIVE settings and the web uploader.

Ask your creators which surface they actually use. Then confirm the brief covers it.

    • Standard video: the post screen, under Content disclosure and ads.
    • Published post: the post’s more options menu, then Ad settings. This is your fix path when a live post is missing its label.
    • LIVE: a separate Content disclosure setting inside LIVE settings, before going live.
    • Web upload: under Show more in the uploader.

LIVE deserves extra attention if you run shopping streams. Disclosure has to be set up before the stream starts, and spoken disclosure timing is a separate risk. Our breakdown of live shopping disclosure timing covers script design.

Your brand or branded content? The selection that changes the label

Once the toggle is on, the creator picks between two options: promoting Your brand or Branded content. They are not interchangeable.

According to TikTok, the setting adds a Commercial content label. It displays Paid partnership if you are promoting a third party and posting branded content. A creator who owns the brand uses the first option. A creator working for yours uses the second. Pick wrong and the label misdescribes the relationship.

Spot-check this on a sample of live posts from each creator tier. It is a thirty-second check per post, and it is the error I see most often in agency audits.

Is the authorization window still open?

When a creator selects Branded content, they tag a brand partner through Brand partnership. TikTok’s page notes that the authorization period is 60 days by default.

That detail matters for operations. If you plan to boost creator content or run whitelisted ads beyond that window, you need a process to renew authorization. Otherwise a campaign built on strong organic performance can stall mid-flight.

Put three things in your tracker:

    1. The date each creator tagged your brand.
    2. The date authorization lapses.
    3. The owner responsible for requesting renewal.

The same logic applies on other platforms. See how the Instagram paid partnership toggle creates a similar audit trail, so a cross-platform tracker is worth building once.

Can TikTok One do the work for you?

Partly. TikTok’s documentation says that all TikTok One projects automatically turn on the Commercial Content Disclosure. It adds that videos posted to your Business Account from TikTok One or TikTok Creative Exchange projects are considered compliant.

That is a real efficiency gain. It removes the human error step for campaigns managed inside the platform. But it only covers work that runs through those channels. Gifted seeding, affiliate partnerships and off-platform agreements still depend on creator behavior.

If you are scaling affiliate programs, pair this audit with a review of TikTok Shop affiliate audits. Strict liability exposure grows with creator count.

    The pre-launch checklist

Run this before any creator goes live. Assign an owner to each line.

    • Contract language: Does the agreement require the toggle on every post, including Stories-style reposts and LIVE sessions? Does it name TikTok’s policy explicitly?
    • Brief language: Does the brief show the correct toggle path for each format the creator will use?
    • Relationship type: Is the creator set to Branded content, not Your brand?
    • Clarity of the product: The branded content policy says the promoted product must be clear without requiring users to visit a profile or link. Is it named verbally or in the caption?
    • Incentive coverage: Are gifted items, affiliate commissions and promo codes treated as disclosable? The policy lists all three.
    • Prohibited categories: The policy bans branded content for several industries, including alcohol, gambling and pharmaceuticals. Confirm your product is not in scope, or reroute the spend. Our guide to regulated category UGC covers the review process.
    • Authorization tracking: Is every tag date and expiry logged?
    • Post-publish verification: Who checks within 24 hours that the label shows? Screenshot it for your records.
    • Remediation plan: If a label is missing, who contacts the creator, and what is the deadline?

What the toggle does not cover

The label handles one slice of disclosure. It does not fix misleading claims, and TikTok’s policy separately bars false, deceptive or misleading claims about the product. It also will not address synthetic content. If your creator uses AI-generated visuals or voice, review the AI disclosure labels guidance as a second layer.

One more practical point from the FTC page. The agency notes that if a company has received notice of penalty offenses and then engages in certain deceptive endorsement practices, the FTC could seek substantial civil penalties. Documentation of your checks is your best evidence of good faith.

Finally, the policy states that TikTok may update its rules and, in some cases, apply them to content already posted. Re-run this audit each quarter, not each campaign.

    FAQs

Is TikTok’s commercial content disclosure setting mandatory?

Yes. TikTok’s Branded Content Policy states that creators must enable the commercial content disclosure toggle when posting branded content. Non-compliant posts can be removed or restricted.

Does gifted product need the toggle turned on?

Yes. TikTok’s definition of branded content includes products gifted by or on behalf of a brand. It also includes paid posts, commissions through affiliate links or promo codes, and brand ambassador relationships.

    What label will viewers see?

Viewers see a Commercial content label. If the creator selects Branded content and promotes a third party, the label reads Paid partnership.

Can a creator add the disclosure after publishing?

Yes. TikTok documents a path through the post’s more options menu and Ad settings. Treat it as a correction step, not a substitute for setting the toggle before posting.

Does TikTok One handle disclosure automatically?

For collaboration projects run through TikTok One, yes. Those projects turn on the disclosure setting automatically, and eligible videos posted to your Business Account are considered compliant. Work outside those channels still needs manual verification.

Are brands liable if a creator forgets to disclose?

They can be exposed. The FTC’s Endorsement Guides FAQ addresses an advertiser’s responsibilities for what others say on social media. Contracts, monitoring and documented remediation reduce that risk.

Before your next brief goes out, add the nine checklist lines to your campaign template and assign one named owner to post-publish label verification. Then run a spot-check on your three most recent live creator posts this week.
